Dictators and the Supreme Court

SINDH – KARACHI: The attorney general of Pakistan told a five-member bench of the Supreme Court of Pakistan headed by Chief Justice Iftikhar Muhammad Chaudhry on August 2, that the Supreme Court has always exonerated military dictators by targeting democratic governments. The attorney general’s comments are based on facts irrespective of intentions. I would humbly suggest that all the judges who have validated military dictatorships in the past should be tried for their decisions under Article 6 of the Constitution.

Pakistan – A History of Judicial Tyranny

26 April 2012 was another tragic day in our democratic history; the unanimously elected Prime Minister of Pakistan who in his wisdom ordered the release of the deposed Lordships of the Superior Courts immediately upon his election was convicted of Contempt of Court. Notwithstanding the uniqueness of NRO judgment condemning over 8000 accused without a hearing and the inherent selectivity of only targeting the President and his aides in the process, the overwhelming part of the judgment was implemented by the Federation of Pakistan. It is pertinent to mention that the grand strategist (of the “strategic depth” fame)–the promulgator of the infamous Ordinance luxuriously resides safe and secure from the wrath of law. Former Prime Minister Mohammad Khan Junejo and his almost 9 March’07 like moment of defiance during the notorious Zia regime is a case in point as to how an instance of individual heroism could not break the dictatorial chains. In case of the present dispensation, it was Benazir Bhutto’s sheer political maneuvering in striving for a political settlement, her ultimate sacrifice coupled with the sagacity of the political leadership along and the democratic struggle unleashed by the lawyers movement which paved way for the return of democracy to Pakistan. The present democratic dispensation is the sequel to NRO. History is bound to narrate as to how if had not been achieved, there would have been no elections, no assemblies, no free media and no free judiciary. The national leadership too would still have been languishing in exile.

Why Muslim states fail

States released from colonial rule in the 20th century have by and large not done well. Today, most of them are either failing or failed states. Only a few have reached the finishing line of liberal democracy with a survivable economic model beyond the 21st century. Most of the Muslim states are included in the failing postcolonial model. Dictators with mental bipolar disorder — historically mistaken for charisma — who aimed to achieve romantic goals have crumbled, leaving in their wake equally romantic mobs of youths demanding what they presume is liberal democracy.

After Saddam Hussein, Iraq is in disarray; after Hosni Mubarak, Egypt is teetering; Libya promises nothing better. And after Musharraf, Pakistan’s democracy is dysfunctional. Among Muslims, only the market state in the Gulf may survive. In the Far East, too, it is the market state that looks like marching on. Muslim Indonesia and Malaysia may survive if they don’t exterminate their entrepreneur Chinese minorities under the spur of Islam. In Europe, when the dictator quits, civilisation takes over and the state survives. No such thing happens in the Muslim world. The premodern seduction of the Muslim mind prevents return to democracy. The blasphemy law is more powerful than any democratic constitution. …

We are aware of how and when Karachi as a fishing village was first founded, and then its march with times to its present status as the only metropolis in Pakistan. But where did it go wrong? Not in its serene but playful presence as a destination of choice between Europe and Asia. Nor, one hopes, in its free spirit as the only city of lights in Pakistan till lights went out from every home under the current regimen of managed power outages, including in Karachi. How Indian Muslims see Pakistan

Concerns about growing religious extremism in the neighbouring Islamic republic have been growing since 2001

How is Pakistan seen by India’s Muslims? Since 2001, the view has turned increasingly negative. Let’s have a look at such views in three very different Indian publications. One is the conservative Urdu daily Inquilab, read almost exclusively by Muslims. The second, the liberal online paper New Age Islam, published in Urdu and English. Lastly, the Hindu extremist Rashtriya Swayamsevak Sangh’s organ Panchjanya, published in Hindi and read almost exclusively by Hindus.

In India’s biggest Urdu newspaper Inquilab, Khalid Sheikh wrote under the headline ‘ Pakistan ka kya hoga?’ He felt Pakistan’s current problems were the result of its own doing (” jaisi karni waisi bharni“). The nation should have known the consequences of using terror to combat India, he said. The world was not unaware of its breeding of Al Qaeda and the Taliban (” sanpolon ko doodh pilaya“). Now the snakes were poised to swallow Pakistan (” nigalne ke dar pe hain“).

Pakistan’s leaders were unconcerned (” kaanon par joon tak nahin rengi“). But the world was watching it. The ease with which the Taliban had attacked and destroyed the P3C Orions in Karachi had worried America, Sheikh wrote. It was now concerned about how safe Pakistan’s atom bombs, which numbered between 70 and 120, were.

In 2001 Pakistan was viewed as a failed state (” nakaam riasat“). After Osama bin Laden’s killing, it won’t be long before it is seen as a rogue state (” badmaash riasat mein tabdeel hote dair nahin lagegi“).

At the time of Partition, it had been predicted by the wise (” sahib-e-baseerat“) that Pakistan would find it difficult to exist (” apna wajood rakhna dushwar hoga“). Sheikh quoted Maulana Azad as writing in ‘India Wins Freedom’ that Pakistan would be unable to find its bearings (” Pakistan kabhi paedar aur mustahkam na reh sakega“). Its foreign policy consisted of hating India (” Hindustan dushmani“) and pleasing America (” Amrika khushnudi“).

The writer thought Pakistan’s insistence that relations with India would improve if the Kashmir issue was settled was untrue (” dhakosla hai“). Pakistan was an unreliable neighbour (” ghair-mu’atbar padosi“) which was a master of creating tension. If Kashmir was resolved, something else would be conjured up.

Sheikh praised Nawaz Sharif’s statement that Pakistan had to stop hating India if it had to progress. US President Barack Obama had said the same thing and America ought to, as France had, terminate military assistance to Pakistan.

Answering the question he had first raised, Sheikh said it was difficult to say what would become of Pakistan because it seemed beyond redemption (” aise mulk ke bare mein kya kaha jaye jahan aawe ka aawa hi bigda hua hai“).

In New Age Islam, Dr Shabbir Ahmed wrote on the blasphemy law under the headline ‘ Pakistan mein tauhin-e-Rasul (PBUH) ka wahshiana qanoon‘. Ahmed said Pakistan was obsessed by this issue (“ hysteria mein jakda hua hai”). Narrow sectarianism had divided the nation, and every sect thought of others as faithless and hated them.

This frenzy was plunging Pakistan into a state of barbarism (” jahiliyat mein ghota zan hai“). Ahmed feared Pakistan might succumb to civil war (“ aisa na ho ke Pakistan khana jangi mein gharq ho jae“).

He said Pakistanis had divided Islam (” deen ko tukdon mein baant diya hai“), and quoted verses from the Holy Quran on the Romans (30:32) to support his argument. It was unfortunate that the majority of Pakistanis, including the educated, were in agreement with disagreeable mullahs. Even intellectuals and lawyers had signed on (” scholars aur wukla ne tauhin-e-Rasul (PBUH) qanoon ki puri himayat ki hai”).

People believed that punishing blasphemy with death was law in five out of 54 Islamic states, but when asked, only two could be named: Pakistan and Saudi Arabia. It was difficult to name other states with such harsh laws, though Afghanistan, Sudan and Iran came to mind.

Ahmed wrote that the Holy Quran prescribed no punishment for blasphemy. No one could be ignorant of the clarity of the ayat ” la ikraha fi ad-deen” (there is no compulsion in religion) because Allah had sent this message to all humanity. This principle was independent and absolute (” is usool mein kisi tarah ki ki riayyat bhi nahin hai“). With many examples, Ahmed pointed to the pardoning and gentle nature of Islam and of Prophet Muhammad (PBUH), which he felt was being distorted by Pakistan’s law.

In Panchjanya, the RSS Hindi weekly, Muzaffar Hussain wrote on May 22 under the headline ” Adhikansh Pakistani Islami khilafat ke paksh mein” (A majority of Pakistanis favours khilafat).

He reported the findings of an opinion poll. The market research company MEMRB had surveyed Pakistanis to ask them what sort of government they wanted. Did they want khilafat as prescribed by Islam? They were also offered the option of tyranny (” anya vikalpon mein janta se poocha hai ke kya woh tanashahi pasand karenge?”). Hussain wrote that by this was meant martial law, and it was related to something found commonly in Muslim nations. This was the presence of sheikhs and kings (” Islami deshon mein aaj bhi raja aur sheikh hain”) who ruled through lineage for generations. The last option offered was democracy “as the world knew it”.

The results were unsurprising to Hussain. The majority of Pakistanis picked khilafat, for which the Taliban were also agitating. How was it possible, then, that anybody could defy the Taliban?

Neutral Pakistanis (” Tattastha log”) were merely being realistic in staying silent against extremism. Why should anyone endanger their life by opposing khilafat? (” Islami khilafat ka virodh karne ki himmat kaun kar sakta hai?”)

The survey was conducted in 30 cities and 60 villages. Those in favour of khilafat were 56%. These people said that Pakistan’s creation was rooted in religion and the state should therefore be Islamic. Those favouring dictatorship were 22%. They felt Pakistan had progressed only under military strongmen (” jo pragati hui hai woh keval sainik tanashahon ke karan hui hai“). Only 11% of Pakistanis preferred secular democracy. These figures did not vary significantly between urban respondents and those in villages, those who conducted the survey said. There was some difference however with respect to the residents of Karachi, Lahore, Rawalpindi and Islamabad. In these cities, 40% preferred martial law and 39% preferred khilafat. In Punjab and Khyber-Pakhtunkhwa, those who wanted khilafat were 60%. In Balochistan and Sindh, about 35% preferred martial law.

The survey did not vary much by age. Those between 16 and 60 preferred khilafat by 66%. Surprisingly, both the illiterate and the very literate approved of khilafat.

Hussain felt that the collapse of the Turkish caliphate had left Muslim nations in disarray (” Islami jagat titar-bitar ho gaya hai”). Both Bhutto and Gen Zia had wanted Saudi Arabia’s king to be crowned caliph of all Muslims.

… The consensus narrative that our security apparatus has tried to promote for the past six decades has collapsed. This narrative is built upon prejudice, denial of historical identities, violent and exclusive interpretations of Islam and the suppression of memories of injustice, crimes and wrongs. The only means to move beyond the impasse we find ourselves in and reframe our major consensus narrative is through the deliberative remembrance of our critical past.

The presidential reference on the Bhutto trial provides an opportunity to our state institutions and public to ground the present reconciliation into truth and justice. The acknowledgment of historic wrongs along with public apologies is the prerequisite for any reconciliation to be successful. Moreover, it is the only way to end the deep distrust and enmity which Zulfiqar Ali Bhutto referred in his last book by quoting the following Urdu couplet.

Na wo badlay na dil badla na dil ki arzoo badli

Main kaesay aitbaar inqlab-i-asmaan kar loon

Arab uprising: What to do with dictators?

Immunity or prosecution for dictators? That tough question hovers over the Arab uprising, just as it has in Latin America, parts of Asia, postcommunist Europe and other places.

In Yemen, international negotiators have reportedly offered amnesty to President Ali Abdullah Saleh as a way to entice him to resign after 32 years in power. Western leaders have hoped, too, that an exit could be found for Libyan dictator Muammar Qaddafi, perhaps by letting him go to Venezuela or places in Africa.

And yet, Egyptian authorities are detaining the deposed Hosni Mubarak for questioning in a military hospital. They want to ask about his role in corruption and the deaths of hundreds of protesters who sought his ouster.

Tunisia’s justice minister, meanwhile, seeks the extradition of former President Zine El Abidine Ben Ali, who fled to Saudi Arabia when youthful demonstrators forced him from his 23-year rule in January. Tunis wants him to answer to more than a dozen charges, including murder and drug trafficking. …

Mercenaries for the Middle East – Dr Mohammad Taqi

The Saudis know that it is nearly impossible for any political uprising there to physically coalesce, due to the population centres being geographically far apart, to cause direct threat to Riyadh.

In his 1983 masterpiece, Can Pakistan survive? The death of a state, Tariq Ali opens the section on Pakistan’s foreign policy during the Z A Bhutto days with the above quote from Trotsky. After duly recognising the limitations of generalising this aphorism, Tariq Ali had noted that many third-world capitals pursue a foreign policy closely mirroring their domestic economic and political policies but perhaps none has done so more grotesquely than Islamabad. Tariq Ali had written:

One of the commodities exported was labour, and the remittances sent back by migrant workers provided nearly 20 percent of the country’s foreign exchange earnings. It was also reported that 10,000 Pakistani prostitutes had been dispatched to the Gulf states by the United Bank Limited (UBL), to strengthen its reserves of foreign currency. Soldiers and officers were also leased out as mercenaries to a number of states in that region. In some ways it was telling indictment of the Pakistani state that it can only survive by selling itself to the oil-rich sheikhs.”

The Pakistani military establishment’s cooperation with Arab dictators obviously dates back to the Ayub Khan era and the UK and US-sponsored Central Treaty Organisation (CENTO) or Baghdad Pact of 1955. However, the surge in the export of mercenaries that Tariq Ali was alluding to was not because of the western sponsorship of such legions but because Pakistan, in 1971, had declared a moratorium on repayment of its foreign debt and had to look for financial aid elsewhere while the IMF would again agree to a loan (which it eventually did). While one cannot confirm the veracity of the claim about the UBL’s venture, the events of the last several months show that somehow the grotesque mediocrity of the Pakistani establishment keeps repeating its antics, as far as the export of the mercenaries goes.

The Arab spring has created unique geopolitical scenarios where old alliances are falling apart — or at least are no longer trustworthy — while new realities are taking shape much to the discontent of regional autocrats. I have repeatedly stated that Barack Obama’s instinct is to side with the democratic movements in the Middle East and North Africa, without intervening directly, even though cliques within his administration have been able to drag him into the Libyan morass. Obama’s handling of Hosni Mubarak’s fall did not go well with Saudi king Abdullah and the bitter exchange between the two, during a phone conversation, is rather well known. The wily Saudi monarch subsequently concluded that if there were to be an uprising in his courtyard, the Americans would not come to his rescue. And unless a smoking gun can be traced to Tehran, Abdullah is right. With Obama getting re-elected — yes I said it — in 2012, the Saudis have chosen to exercise other options that they have heavily invested in, for decades, to protect their courtyard and backyard.

The Saudis know that it is nearly impossible for any political uprising there to physically coalesce, due to the population centres being geographically far apart, to cause direct threat to Riyadh. But they also know that the democratic contagion can spread at the periphery of the Kingdom, with the oil-rich Eastern province slipping out of control quickly or the disquiet at the Yemeni border keeping Riyadh distracted (the latter was tested by both Gamal Nasser and Iran). The Saudi plan, just as in the 1969 bombing of Yemen by Pakistani pilots flying Saudi planes, is to use the trusted Pakistani troops to bolster the defence of not only the Saudi regime but of its client states like Bahrain.

It is not a surprise then that before Saudi Arabia invaded Bahrain on March 13, 2011, the chief of Saudi Land Forces, General Abdul Rahman Murshid visited Pakistan and before that, on March 9, met General Ashfaq Pervez Kayani. Bahrain had already requested and received assurance for military help from Pakistan in late February 2011. In fact, a leading Urdu paper carried an advertisement from the Fauji Foundation Pakistan on February 25 and March 1, seeking men for recruitment to the Bahrain National Guard. The qualifications sought were the following: age 20-25, height of six-feet or taller and military/security service background especially in riot control, which suggest that enrolment was not exactly for the Manama Red Crescent Society.

After the Saudi army brutally crushed the uprising in Bahrain, the Foreign Minister of Bahrain, Sheikh Khalid bin Ahmed al-Khalifa, met with Prime Minister Yousuf Raza Gilani and the State Foreign Minister Hina Rabbani Khar. While the Bahraini media splashed pictures of the handshake between Ms Khar and Sheikh Khalid, announcing Pakistani support to Bahrain, the actual backing had been pledged by the Chief of General Staff, General Khalid Shamim Wayne, whom the Bahraini minster met on March 29.

In her article titled ‘Bahrain or bust?’, Miranda Husain writes: “Chomsky believes Pakistani presence in Bahrain can be seen as part of a US-backed alliance to safeguard western access to the region’s oil …The US has counted on Pakistan to help control the Arab world and safeguard Arab rulers from their own populations… Pakistan was one of the ‘cops on the beat’ that the Nixon administration had in mind when outlining their doctrine for controlling the Arab world.” Ms Husain and the American Baba-e-Socialism (Father of Socialism), Chomsky, conclude with the hope that Pakistan should not meddle in the Middle East.

I believe that Chomsky’s reading of the situation in the Persian Gulf is dead wrong. It is the divergence — not confluence — of US-Saudi-Pakistani interests that is the trigger for potential Pakistani involvement there. The Pakistani brass’ handling of the Raymond Davis affair and now its insistence — through bravado, not subtlety — on redefining the redlines with the US indicates that just like the 1971 situation, an alternative funding source to the IMF has been secured. The Pasha-Panetta meeting has raised more issues than it has solved. Pakistani-Saudi interests are at odds with the US and are confluent with each other.

From the Kerry-Lugar Bill to the Raymond Davis saga, the mullahs have been deployed swiftly to create an impression of public support for the establishment’s designs. Last Friday’s mobilisation of the religious parties in favour of the Saudis is the establishment’s standard drill and will be repeated as needed. The Pakistani deep state apparently has decided to keep selling itself to the oil-rich sheikhs. The domestic policy of coercion and chaos will be continued in foreign lands too.

Parrot writers and journalists in Pakistan always praise the position of a serving Army Chief. Those who have sold their souls tell us how great the military’s top brass is. It does not matter if it includes generals, who surrendered in Dhaka, and those who ran away from Kargil, or those who killed an elected Prime Minister and tore apart the constitution. Even military leaders accused of corruption, incompetence and misconduct are portrayed as heroes.

It is not surprising that we are told that the current Army Chief, General Ashfaq Parvez Kayani, is the only capable saviour of Pakistan. Analysts, anchorpersons and columnists, who pretend to be mouthpieces of the military, inform us that General Kayani is different than his predecessors.

Not very long ago, General Kayani was the right-hand man of General Parvez Musharraff. After Kayani became the Commander-in-Chief, General Musharraff received a guard of honour at the end of his illegal stay in the President House. The military is a state within the state in Pakistan. The sword of a military intervention still hangs over the civilian government as the power equilibrium continues to be in the military’s favour even under General Kayani.

Nonetheless, so far, General Kayani has acted wisely and he appears softer than the previous heads of the Pakistani military. The Armed Forces are supposed to defend a country but the Pakistan military has embarrassed Pakistan many times. The Armed Forces are a symbol of pride for the people of a country; in Pakistan the military has caused national discomfiture. Some Pakistani generals wanted to make history—they left with dark history. ….

…. At the same time, the Supreme Court of Pakistan and the Lahore High Court must reverse the decision of Bhutto’s judicial murder and seek an apology from the people of Pakistan. The Supreme Court is guilty of gross injustice. The Bhutto case is a stain on the institution of judiciary. Bhutto’s blood will stay fresh in the courtrooms until justice is done and Bhutto’s dignity is returned to him by the Court. The integrity and respect of the Supreme Court of Pakistan will never be restored without declaring Bhutto innocent and calling him Pakistan’s national hero.

Also the Supreme Court should formally admit that judges who were instrumental in providing legal cover to martial laws and dictators were actually traitors. The Court should give a similar verdict about generals who imposed military coups and derailed Pakistan. …

Pakistan – Big boots are marching in!

Any political change, constitutional or unconstitutional, imposed by the military in Pakistan  will further complicate the internal chaos by creating more political conflicts rather than resolving them as we have seen during the last military dictatorship of General Pervez Musharraf.
History shows military leaderships in Pakistan never learn from the past but surprisingly it was different this time around. In the “fine” tradition of military dictators coming to power by force and clinging to it until they are forcefully removed, the situation was ripe again during the  last two weeks when rumors were abound that the big boots were coming again to “save” Pakistan. …
