SINDH SOLIDARITY CONFERENCE DECLARATION
This representative gathering of political parties, writers, intellectuals and civil Society stakeholders has extensively deliberated today on the conspiracies against the unity of Sindh. In its view, the ruling alliance of PPP-MQM has conspired again and again to pave the way for divisiveness, lawlessness and terrorism in Sindh and their policies have plunged whole province into a wave of terrorism, lawlessness and corruption.
It may be recalled that the ruling alliance conspired on 6th August, 2011 to divide Sindh administratively but it was foiled by the valiant struggle of people culminating in historic strike of 13th August, 2011. Again MQM, with the support of ruling alliance presented an ominous amendment in National Assembly aimed at snatching the power of provinces to decide about their unity. On 28th January, again strike was called which successfully put to an end to the efforts to amend article 239(4) of the constitution.
In no uncertain terms, the people of Sindh had declared that constitution of 1973 does not confer the power of creating more provinces upon any authority whatsoever. Article 239 only speaks about the alteration in the limits of the existing provinces which can’t be equated with the power of creating new provinces. In order to fulfill its nefarious designs, the ruling alliance not only misinterpreted the constitutional provision but passed a resolution in National Assembly to create a new province which is totally unconstitutional and immoral.
We believe that for creating a new constituent unit, the consent of all four constituent units is sine qua non as their interests could be affected in different constitutional forums and unless all the four provincial Assemblies pass resolutions with two third majorities, no new constituent unit could be created. Creating a new province is a constituent power which resides in the provinces and constituent Assembly declined to confer this power on parliament in 1973. Even no amendment in the constitution could be brought about affecting the Federal or parliamentary character of the state. It has been declared by the Supreme Court of Pakistan in numerous cases.
We believe that the people of the country have been misled by the ruling coalition on the issue of creation of provinces as the ruling parties have miserably failed to deliver to the people during these four and half years. In order to divert the attention of people from their misrule, maladministration, corruption and terrorism, they have chosen to ignite the emotions of people and thus played with fire against the integrity, unity and solidarity of Sindh and the country.
We strongly believe that Sindh is an indivisible constituent state of the country and has surrendered certain powers to the Federation under an agreement to manage the affairs of Federation in just and fair manner. However, it has got a raw deal at the hands of successive rulers and the present ruling coalition has destroyed its political, economic, social and cultural fabric.
For the sake of its power and financial interests, it has torpedoed the sacred unity of Sindh by raising the bogy of Southern Sindh province. Ironically, in southern region of the province the very boggy of so-called Muhajir province is not only ridiculous but baseless, self-serving and self-defeating.
