Canada drops in worldwide justice index

Access to justice is discriminating against poor and immigrant populations, says a new report by the World Justice Project.

A new report from suggests immigrant and poor populations are being discriminated against in Canada because of a limited access to justice. Canada dropped since last year in six of the eight “Rule of Law” factors listed in the report from the World Justice Project.

The report ranked Canada among 97 countries worldwide in categories including government power, corruption, order, fundamental rights, open government, enforcement, and civil and criminal justice.

Some 97,000 people were polled worldwide, in addition to 2,500 experts in 97 countries to compile the report.

Parliament cannot discuss SC judges’ conduct: SC

Supreme Court has said PAC cannot carry out audit of apex judiciary as per Article 58.

According to a report presented to the Public Accounts Committee (PAC) on Tuesday morning three existing and twelve retired judges of the Supreme Court received two residential plots each worth millions of rupees in expensive sectors of the federal capital.

The Supreme Court (SC) refused to provide audit report details to the Public Accounts Committee (PAC) saying the Parliament cannot review judges conduct.

This was said in a reply written by Registrar Supreme Court to the Chairman Public Accounts Committee with the consent of full court bench of the Supreme Court in which it is mentioned that constitution prohibits PAC to call any official including Registrar of the apex judiciary, however President, being head of the state has the authority to decide about the consultative sphere of the Supreme Court, so the committee should consult President of Pakistan

If the committee is interested in a formal court order, it should approach the president , the letter said

The letter referred to Article 68 which said: “No discussion shall take place in [Majlis-e-Shoora (Parliament)] with respect to the conduct of any Judge of the Supreme Court or of a High Court in the discharge of his duties”.

It is worth mentioning here that on the orders of former Chairman PAC Chaudhary Nisar Ali Khan, a letter was written to the Registrar Supreme Court for presenting its accounts before the committee, however it was not dispatched at that time. But new chairman Nadeem Afzal Chan ordered to dispatch it.

Tribute to Comrade Sobho Gianchandani

Sobho Gianchandani is a prominent Sindhi revolutionary who remains a source of inspiration for many generations of Sindhi activists, writers and social reformers. Mr. Gianchandani, known lovingly as Comrade Sobho, has been associated with many political  and campaign groups, including the Indian National Congress and Khudai Khidmatgar and is the founder of many progressive, democratic and nationalist campaigns in Sindh. After the partition, Pakistani authorities pressured himlike millions of other Sindhi Hindus — to leave Sindh and migrate to India, but Sobho refused, and in consequence he was forbidden to travel abroad until 1998. Sobho was imprisoned for more than a year during the British rule, and after the partition, he fell under the wrath of Pakistani establishment and has many jail sentences to his credit, including one in 1971 for opposing military sponsored genocide in Bangladesh. Comrade Sobho and G. M. Syed were close associates and comrades in different aspects of the Sindhi rights movement. The G. M. Syed Memorial Lifetime Achievement Award is bestowed on Mr. Gianchandani in appreciation of his life-long struggle for emancipation for Sindhis and other oppressed peoples of South Asia and in recognition of his grass-roots efforts to promote tolerance, justice, communal harmony and peace. …..

– Another judge refuses to hear Afaq`s petition

KARACHI, July 25: The petition of Afaq Ahmed, the chairman of the Mohajir Qaumi Movement, better known as MQM-Haqiqi, seeking protection against political victimisation and prosecution in false cases could not be heard on Monday as another judge of the Sindh High Court refused to proceed with the matter.

Justice Ahmed Ali M. Shaikh told Mr Afaq`s counsel that he could not proceed with the petition.

Earlier, Justice Mohammed Athar Saeed had refused to proceed with Mr Ahmed`s petition that was transferred to another judge, Tufail H. Ebrahim.

However, the petition was later transferred to Justice Shaikh after the resignation of Justice Ebrahim. ….

Jewish court sentences dog to death by stoning

(AFP) – JERUSALEM — A Jerusalem rabbinical court condemned to death by stoning a dog it suspects is the reincarnation of a secular lawyer who insulted the court’s judges 20 years ago, Ynet website reported Friday.

According to Ynet, the large dog made its way into the Monetary Affairs Court in the ultra-Orthodox Jewish neighbourhood of Mea Shearim in Jerusalem, frightening judges and plaintiffs.

Despite attempts to drive the dog out of the court, the hound refused to leave the premises.

One of the sitting judges then recalled a curse the court had passed down upon a secular lawyer who had insulted the judges two decades previously.

Their preferred divine retribution was for the lawyer’s spirit to move into the body of a dog, an animal considered impure by traditional Judaism.

Clearly still offended, one of the judges sentenced the animal to death by stoning by local children.

The canine target, however, managed to escape.

“Let the Animals Live”, an animal-welfare organisation filed a complaint with the police against the head of the court, Rabbi Avraham Dov Levin, who denied that the judges had called for the dog’s stoning, Ynet reported.

One of the court’s managers, however, confirmed the report of the lapidation sentence to Israeli daily Yediot Aharonot.

“It was ordered… as an appropriate way to ‘get back at’ the spirit which entered the poor dog,” the paper reported the manager as saying, according to Ynet.

Certain schools of thought within Judaism believe in the transmigration of souls, or reincarnation.

In-camera session: ISI chief shot back at ‘favour-seeking’ Nisar

ISLAMABAD: Though he spent a large chunk of the marathon session on the back foot, besieged by politicians, the chief of Pakistan’s premier intelligence agency did come out of his shell to silence fiery Leader of the Opposition in the National Assembly Chaudhry Nisar Ali Khan.

Details of Friday’s closed-door session of a special joint sitting of Parliament continue to trickle out – with some interesting nuggets of information being narrated to The Express Tribune regarding an exchange between Director-General of the Inter-Services Intelligence (ISI) Lt-Gen Ahmad Shuja Pasha and Chaudhry Nisar.

Reported yesterday was a fiery speech by Nisar against the military establishment – but it emerged, through fresh information, that the DG ISI did not just stand there and take the tirade.

Pasha, who has been at the receiving end of a number of fiery speeches by the PML-N leader over the last few weeks, is said to have shocked Nisar by replying in the same token.

Nisar is said to have risen out of his seat for his speech right as the question and answer session was to begin. But a “visibly angry” Pasha snubbed Nisar in front of a full house.

Pasha claimed that he ‘knew’ why he was being targeted by the leader of the opposition as of late – alleging that Nisar had asked him for a personal favour, which he, as DG ISI, refused to extend.

Since then, said Pasha, Nisar had launched a number of tirades against him in particular and the military in general. However, Pasha said he would not reveal what the favour was on the floor of the august house – but would if asked outside.

An embarrassed Chaudhry Nisar was said to have been taken aback as Pasha continued with his ‘counter-attack’. The DG ISI kept on grilling Nisar, asking the PML-N leader if he knew what the effects of his recent tirades had been. Pasha told the house that on a recent trip to the US he was told by CIA chief Leon Panetta in an important meeting: ‘Look, General Pasha – how can we trust you when your own country’s opposition leader is saying that you cannot be believed?’

16th December 1971 was the day of the demise of two nation theory, a fake theory to control a land under the so-called ideology of one Muslim nation.

Bengalis fought against the illegal, unconstitutional and immoral domination of civil and military establishment of West Pakistan. A very progressive federating unit brawled against the political and economic disparities. Bengalis refused to live a slaves’ life.

We still have time to save rest of the Pakistan by accepting the fact that Pakistan is made of five historical nations and centuries old civilizations. Rest of the country should declare Sindh, Punjab, Pukhtoonkhwa and Balochistan as sovereign federating units as promised in 23 March, 1940 Lahore resolution.

December 16th is a day of inspiration to fight against the civil and military establishments/ dictatorships, who want to make us a garrison state, and we have to continue our struggle to make Pakistan a true federation.

….. Here, our easily purchasable politicians and bureaucrats do not hesitate to barter away their souls and, in Reko Diq’s case, the asking price is not their souls but the easily dispensable rights and future of the Baloch people.

The rights of the Baloch people seem inconsequential to the centre and they flout them with brazenness. Recently, Balochistan Assembly Speaker Mohammad Aslam Bhootani minced no words and exposed the immense pressure being put on them by the Prime Minister’s House to allot 70,000 acres in the environs of Hingol National Park to Arab princes for rest and recreation. He emphasised that the Balochistan government had earlier refused this land to a federal security institution because of the local people’s opposition. The Arab princes would do well to remember that in Balochistan they will not enjoy the tranquillity that Cholistan offers because here the people will definitely resist their unwanted presence.

Sheikh Khalifa bin Zayed Al-Nahyan, president of the UAE, alone has been allotted hunting permits in Zhob, Ormara, Gwadar, Pasni, Panjgur and Washuk districts. Pakistan is a signatory of the UN Bonn Convention on migratory species, which protects the endangered Houbara Bustard. But expecting respect for ‘bird rights’ where ‘human rights’ suffer immeasurably is infantile fantasy.

The Arab royalty have also been granted tax exemptions for all their property and imports for hunting purposes. The Federal Bureau of Revenue (FBR) clarified that “similar exemptions were also given to the United Nations, charitable organisations and diplomats”. The Arab rulers certainly qualify as ‘charitable organisations’ for the rulers and politicians here. They give them asylum and plead their case with the US.

The Pakistani politicians and the establishment are very fragile and vulnerable to pressures as is amply proved by the WikiLeaks or rather the ‘Wikitorrents’ that they have turned into. WikiLeaks certainly threatens to sweep away many a reputation and career around the world except perhaps in Pakistan and the Middle East where phenomenally shameless unashamedness or Schamlosigkeit exists as a unique quality in the rulers and establishments; the worse the reputation, the better are the chances of success.

The respect that the Arab princes and rulers accord to the rulers and politicians here is apparent from the choice epithets used for them in WikiLeaks. Some are considered dirty but not dangerous and others are dangerous but not dirty, and yet these shameless people go grovelling to their liege lords like serfs and subjects.

These rulers and politicians and the establishment sacrifice self-respect for material benefits; they cannot be expected to stand up for the rights of the Baloch people over their resources and land. And, moreover, because the Baloch do not expect them to protect their rights, they will resist Tethyan and the Arab princes’ encroachments on their land and resources in the same way that made, in spite of the huge military presence, Amoco Oil Company give up oil exploration in the Marri area in 1974.
