Complaint was filed by Democracy Watch and University of Victoria on Feb. 20

By CBC News

Canada’s information commissioner has confirmed that her office will investigate allegations that the federal government is muzzling its scientists.

The office of Suzanne Legault has concluded that a complaint made by Democracy Watch and the University of Victoria’s Environmental Law Clinic in February falls within its mandate, wrote Emily McCarthy, assistant information commissioner, in a letter released Monday by Democracy Watch, an Ottawa-based non-profit organization that advocates for government accountability.

The letter, dated March 27, added that the office has notified and sent a summary of the complaint to the relevant government institutions:

  • Environment Canada.
  • Department of Fisheries and Oceans.
  • Natural Resources Canada.
  • National Research Council of Canada.
  • Canadian Food Inspection Agency.
  • Department of National Defence.

Treasury Board included

The letter added, “We have also determined that the Treasury Board Secretariat should be included in your complaint because of its role in relation to the development and implementation of government policies.”

Tyler Sommers, co-ordinator of Democracy Watch, said in a statement, that the group is “very pleased” about the investigation being called.

“And we will continue to push the information commissioner to get to the bottom of this situation, publicly release the results, and push the federal government to change these policies,” he added.

The complaint, filed on Feb. 20, suggested that federal government policy “forcing scientists to jump through hoops before speaking with the mediabreaches the Access to Information Act.

The complaint included a 26-page report with 100 pages of appendices, containing details and examples, based on internal government documents previously released through freedom of information requests, along with conversations with current and former federal public servants, journalists, members of non-profit organizations, and professors at Canadian universities.

The federal Access to Information Act requires the Office of the Information Commissioner to investigate “any matter related to obtaining or requesting access to records” from federal institutions.

Creation of Metropolitan Corporations

· Government will create Divisional Head Quarter of Karachi, Hyderabad , Sukkur, Larkano and Mirpurkhas as Metropolitan Corporations But Karachi Metropolitan will be consist of five districts [Note: only Karachi is different from all other Metropolitan all other metro will be consists of only one district while Karachi five]

According to 1998 census MQM has only majority in two districts out of five. If Karachi Metro consists of five District Councils then MQM can have control on only two district councils and they cannot even win mayor ship of Karachi Metro! So MQM knowingly using this Ordinance created Karachi Metro based on five districts instead of 18 towns.

· Union Council boundaries with in the Metro area cannot stretch into any Talku or town

Please note that this doesn’t apply to Town boundaries, there are 5 districts and 18 towns are in Karachi. 18 towns were created in dictator Gen. Musharaf period gerrymandering so that MQM elect their Mayor. It was not possible before since out five districts MQM can only elect two districts only.

This also shows that Karachi is different from other Metro areas.

· Through this ordinance Mayor and Chairman have authority to remove encroachment and maintain peace using Criminal Procedure Code 109, 133, 143, 144 and 145 under the Police act of 1861 and under section 30A-34B. Also they have section 144 under their authority.

Using this authority MQM Bulldoze any Sindhi area, do not allow any political rally and activity, remove any flood relief camps etc.

· Using their financial resources councils have authority to create any new department

Obviously only Karachi and Hyderabad has revenue to create any new department. We already had seen how MQM created city police by recruiting its entire party worker. Rest assured how will these departments server the city.

· Using this ordinance Deputy Commissioner office becomes irrelevant and all the powers are transferred to Chief Officer, who reports to Metro Government. Only revenue matters left to DC office but Karachi will be different again.

Now you can imagine how MQM will utilize Chief Officer Office.

· Financial grant of Metro based on its financial needs, revenue potential and revenue generation

In other words since Karachi and Hyderabad generate most the revenue hence they need more money and rest of Sindh will go to hell. There is no parity for poverty which considers in federal divisible pool.

· Using this Ordinance there are many departments moved to Metro area but most consequential are primary education and fisheries

If Karachi metro can regulate primary education it means the small number of Sindhi medium school running will be closed and there will be no new sindhi medium school will open. Also fisheries department transferred to Karachi Metro mean they will regulate all the harbors where majority of Balochs and Sindhi currently works. They will also not allow any new fishermen housing society in future.

· Military dictator Gen. Musharaf police Ordinance only reactivated in Karachi only, rest of Sindh will still in 1861 act

Memogate’ scandal threatens Pakistan stability

PAKISTAN’S Supreme Court opened a potentially government-toppling commission into the “Memogate” scandal yesterday, ignoring accusations from the human rights commissioner that the law was being used to transform the country into a “security state”.

Asma Jehangir, also president of the Supreme Court Bar Association, lashed out at the judiciary as she announced she was standing aside as legal counsel for former US ambassador Husain Haqqani because she believed he had no chance of a fair hearing.

SDF urged MPs to reject dictator Musharraf’s undemocratic, repressive & discriminatory local govt ordinance

– MPAs urged to reject revival of LB system

HYDERABAD, Aug 11: The Sindh Democratic Forum (SDF) has appealed to the members of Sindh Assembly not to vote in favour of the ordinance promulgated about revival of the district government system in Sindh.

It urged MPAs to protect sanctity of their legislative power and defend the bill they had passed to get rid of a dictatorial system to divide Sindh.

It congratulated those legislators of Sindh Assembly who revived the commissioner system, adding that it was the time for every legislator to prove his loyalty to Sindh.

In a statement issued here on Thursday, the SDF alleged that the district government system was introduced by a dictator to hand over cities of Sindh to a specific group as independent administrative units. Under the system, a city of 20 million people was made a district while another city of Sindh was divided into four districts.

It said the commissioner system would ensure decentralisation of power and Karachi would come into its former position of five districts, which would ensure fair delivery of service to all, including minorities and other ethnic groups living in the metropolitan.

It criticised what it termed somersault of the government, saying that it revealed that the present government was so weak and baffled that it had succumbed to the pressure of killings in Karachi by a political group with terrorist outfit. The sons of Sindh were bewildered on the statement and actions of the person who was sitting in London, heading a political group and calling himself son of Sindh, but his actions were against the wishes and rights of Sindh.

It demanded that he should demonstrate his sincerity towards Sindh by denouncing Musharraf`s ordinance and should support the demand of Sindhis to restore five districts of Karachi and revival of Hyderabad district in its original position.

It supported the strike call for Aug 13 and requested all the people of Sindh to wear black armbands and demanded from the MQM leadership to denounce the Local Government Ordinance 2001 and demonstrate solidarity with the people of Sindh.

DEMONSTRATION: Activists of the Awami Tahreek, its women wing Sindhiani Tahreek, and students wing Sindhi Shagird Tahreek held a demonstration outside the press club here on Thursday to pay tribute to Zafar Ali Shah, Nabeel Gabol, Nawab Mohammad Yousuf Talpur, Ms Humera Alwani, Nawaz Chandio, Ayaz Amir and Hakeem Baloch for their courageous stand on the local bodies issue.

Speaking on the occasion, the leaders said that the PPP had committed treachery and treason with Sindh just to prolong its rule.

They said that by abolishing commissioner system throughout Sindh and restoring the local bodies system of the dictator, the PPP was trying to appease an ethnic terrorist organisation.

Those legislators who had raised their voice with the people of Sindh were true sons of the soil, they said and expressed the hope that other MNAs and MPAs would also emulate their brave and courageous colleagues.

JST: In view of the strike call given by the Sindh Bachayo Committee for Aug 13 throughout Sindh, the Jeay Sindh Tahreek has postponed its protest rally scheduled to be held in Karachi on Aug 15.

In a joint statement faxed to Dawn here on Thursday, the president JST, Dr Safdar Sarki and others said that the Aug 15 rally by the party had been postponed to ensure the success of the strike called for Aug 13. They called upon the party workers to fully participate in the strike call.

They paid tribute to Zafar Ali Shah, Nawab Yousuf Talpur, Mir Nadir Magsi, Ms Humera Alwani and Ms Sassui Palijo other brave sons and daughters of Sindh for taking a brave and courageous stand against the local bodies` issue.

They pledged to foil all anti-Sindh conspiracies through practical struggle.

The PIL was submitted by advocate Qazi Rashid Shamas. The petitioner alleges that structures were being built on the river bed at three places— Mamar, Murgund and Knagan in violation of various statutes.

“In the process water is getting polluted and if immediate steps for retrieving river from encroachments and removing illegal constructions are not undertaken, the river environment and the surrounding ecology faces threats and hazards,” reads the PIL.
